The purpose of these general terms and conditions of sale is to define the conditions of access and use of the Solution. The Solution allows you to share photos, videos, messages or documents on a TV screen.
The website www.sunday.love is published by the simplified joint stock company HOPEN PROJECT SAS, whose registered office is 7 Rue BOURLY - 33700 MERIGNACy, Bordeaux, registered with the Paris Trade and Companies Register under number 811 939 453. To contact Sunday, you can send an email here.
They aim to define the contractual relationship between the company SUNDAY.LOVE and the buyer, and apply to any purchase made on the merchant site https://sunday.love. These conditions of sale shall prevail over any other general or special conditions not expressly approved by the company HOPEN PROJECT. These Terms and Conditions of Sale may be subject to change by the Provider. The version of the General Terms of Sale applicable is the one in force at the date of use by a User of the Solution. The General Terms and Conditions of Sale apply without restriction or reservation to all Services provided by the Service Provider to any User of the Solution, to the exclusion of all other conditions. Any order placed on the https://sunday.love merchant site implies the full and unreserved adherence of the buyer to these Terms and Conditions of Sale.
The online sale of the products presented on the site is reserved for buyers who have made their purchases via Internet, in application of French law, the company's place of residence.
3.1 Sunday Box
The Service Provider has developed and edited the Solution mainly intended to enable its Users to share photos, videos, messages or documents with family members or friends directly on their TV screens connected to the Sunday Box.
3.2 Sunday Box 3G
The Sunday Box works in Wifi and the 3G Sunday Box is equipped with a 3G key: the Sunday Go. Thanks to the Sunday Go, the Sunday Box can operate in 3G in geographical areas that allow 3G broadcasting.
The Customer, after having familiarised itself with the potential, purpose and functionalities of the Solution identified in the commercial proposal and after having appreciated the opportunity to request a detailed presentation of the Solution from the Service Provider, has decided to take advantage of this opportunity to contact the Service Provider.
The Customer acknowledges that it has received all the information and advice required to assess the Service Provider's proposal and has ensured that the Solution meets its needs.
It is the Customer's responsibility to ensure: that the Solution meets its own needs, in particular on the basis of the information provided in the documentation submitted to it; that it has the necessary skills for accessing and using the Service and the Solution; that it has sufficient bandwidth and network access to access the Service and the Solution in accordance with the Service Provider's requirements.
4.1 The price of the Sunday Box is 99 Euros including including taxes .
4.2 The Sunday Go subscription is 7.99 Euros per month including taxes
4.3 Billing on subscription
The sums due by the subscriber under the Contract shall be the subject of invoices issued monthly, in advance for the Service and additional and optional services included in a flat-rate offer and in arrears for communications, services or options not included in a flat-rate offer. The invoices shall be sent to the subscriber on a dematerialised medium (invoice by e-mail).
4.4 Payment for subscription
Sunday offers the subscriber the possibility of paying for the Service by direct debit from a current account (bank or postal account), by credit card. If the subscriber is unable to pay for the subscription, Hopen Project will make 3 reminders. If after 3 reminders, the subscriber has still not paid the subscription fee, he will be charged 150 euros per bailiff's order.
4.5. The subscriber is invited to regularly consult the Sunday Newsletters communicated by Sunday to be aware of any new message and information concerning the Service.
4.6. Sunday may be required to amend the contractual terms and conditions for the provision of the Service. The Subscriber will be informed at least 1 month before the changes come into force.
The prices of the Service may be modified in the event of legislative or regulatory changes, for example an increase in VAT. The subscriber will be informed at least 1 month in advance.
The Customer undertakes to pay the royalties allowing him access to the Solution that he makes available to Users. The Customer undertakes to use the Solution solely for its purpose and destination. The Customer undertakes to grant rights to use the Solution only to the necessary Users. The Customer undertakes to use the Solution lawfully, in accordance with the legal and regulatory provisions in force, these General Terms and Conditions of Sale and the purpose of the Solution. The Customer agrees not to publish, distribute, store or transmit illegal content that infringes: persons, whether Users or third parties; intellectual or industrial property rights; public order and morality.
Since underage Users may use the Solution, Users are therefore strictly forbidden to include violent, pornographic or generally speaking any content that may shock or disturb a minor child. The Customer undertakes, where appropriate, to insert hypertext links that do not refer to illegal content or content that infringes the rights of third parties. The Customer assumes full editorial responsibility for the content sent to Users on the Solution. Consequently, the Service Provider shall not be liable in any way for the content published, distributed or transmitted by the Client.
Payment for services will be made by credit card (Blue, Visa, Mastercard). The payments made will be secured by a data encryption procedure to avoid the interception of this information by a third party. The buyer must check the details of his order, and in particular the total price including all taxes and any reductions, the method of payment, the method of delivery and correct any errors. The seller sends the customer an order confirmation by e-mail. The conclusion of the contract only takes place after confirmation of the order by the seller and validation of the payment.
The seller reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order. The seller reserves the right not to record a payment and/or not to confirm an order for any reason whatsoever, in particular due to a product supply problem. Any Order validated by the Customer is final. In accordance with the regulations in force, the bank details of the customers are not kept by the Company HOPEN PROJECT SAS.
1. Cost of delivery
Delivery costs will be indicated to the Customer before any payment is made. The amount of the delivery costs is indicated in the Order Basket, in the Order summary and on the invoice. Shipping costs are not refundable. If you refuse a Sunday delivery, you will be held responsible for the original shipping costs, plus the cost of returning the package to our warehouses. This amount will be deducted from any credit issued. Except in exceptional circumstances, such as a late cancellation of your order, which will result in your package being shipped. You will therefore be able to refuse delivery so that the package can be returned to us.
2. Delivery address
The Customer is perfectly informed that the delivery of the Products is ensured in metropolitan France and within the limits of the delivery zones indicated on the Site.
The Products can only be delivered to the delivery address that you provided when placing your Order. Please make sure that you fill in the "address" fields correctly, taking care not to overlook any details (access codes-digicode, name of building or residence, building number or any particularities concerning your address) in order to allow for a quick delivery. The company HOPEN PROJECT SAS shall not be held liable for any incorrect or incomplete address, preventing or delaying the delivery of the Products.
3. Processing time
All orders are subject to a separate processing time, with the exception of the time it takes for a shipment to reach its destination once it has been picked up from our processing centre by the carrier. The processing and shipping time for orders is 2-5 business days. Hopen Project cannot be held responsible for delays, loss, theft or damage to goods and materials during transport. The recourse against the carrier will have to be provoked by the recipient. Reservations must be confirmed by registered letter to the carrier in accordance with articles 105 and following of the Commercial Code and within 3 days, not including public holidays following the day of receipt.
Please note that orders can take 12 to 18 business days for France from the date of shipment and 14 to 20 business days for the rest of the world, not necessarily from the date they were placed, depending on the final destination of the order.once your order has been shipped, you will receive an email with tracking information. You can also track the status of your order from the link sent to you upon order confirmation.
4. Delivery Declaration
If you notice a non-delivery or if the tracking information indicates that your package has been delivered by the carrier but you have not received it, you must contact us within 7 days to make a claim.
We assume no responsibility for packages that have been reported as having been delivered by the carrier. We do not issue refunds or credits for packages whose delivery has been confirmed by the carrier.
Our Sunday policy lasts 14 days. If 14 days have elapsed since your purchase, we are unfortunately unable to offer you a refund or exchange. To qualify for a return, your item must be unused and in the same condition as you received it. It must also be in the original packaging. To make a return, you must present us with a receipt or proof of purchase that you will take care to enclose with the return package.

We replace an item only if it is defective or damaged. If in this case you wish to exchange it for the same item, CONTACT US.
All products supplied by the seller benefit from the legal guarantee of hidden defects provided by articles 1641 and following of the Civil Code and the legal guarantee of conformity provided by articles L. 211-4 and following of the Consumer Code.
The legal guarantee of conformity enables the customer to obtain, within two years of delivery of the product and free of charge, the repair or replacement of the product if it does not conform to the contract. In case of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or refund it. If repair or replacement is impossible, the buyer may return the product and be refunded the price. If the replacement or repair of the purchased product involves a cost that is clearly disproportionate to the value of the good or the importance of the defect, the seller may decide to proceed with the refund.
In accordance with the legal guarantee for hidden defects, the customer may request, within two years from the discovery of the defect, total or partial reimbursement of the product, if it is unfit for use.
In this case, the customer shall inform the seller of his request by registered letter with acknowledgement of receipt and shall return the product concerned to the seller, accompanied by any evidence justifying the defect. In the event of the proven existence of such a defect, the seller will reimburse the customer, as the case may be, all or part of the price of the product.
In accordance with the law relating to data processing, data files and liberties of January 6, 1978, information of a nominative nature relating to the purchasers may be the subject of automated processing.
The seller reserves the right to collect information on buyers, including by using cookies, and, if he wishes, to transmit to business partners the information collected.
Buyers may object to the disclosure of their details by notifying the seller at the time of the order. All elements of the Site, whether visual or audio, texts, layouts, illustrations, photographs, documents and other elements, including the underlying technology, are protected by copyright, trademarks and patents worldwide. In the absence of prior written authorisation by the seller, any reproduction in whole or in part constitutes an infringement and is punishable under the Intellectual Property Code.
The Customer is solely responsible for the use of his identification elements, he is obliged to keep them secret. Any disclosure on his part can in no way be blamed to https://sunday.love.
Any order placed using the Customer's login and password is deemed to have been placed by the Customer. The company HOPEN PROJECT SAS, can in no case be held responsible in the case of any damage resulting from the use of the Internet network such as loss of data, intrusion, virus.
The sales contract formed between the seller and the buyer at the time of purchase by the latter on the sales site https://sunday.love is subject to French law. In the event of a dispute, jurisdiction is given to the territorially competent courts in Bordeaux, France.
The company HOPEN PROJECT SAS cannot be considered as engaging its responsibility for total or partial contractual non-fulfilment which would be due to an event of force majeure, independent of our will. In case of force majeure as defined by the Civil Code, the obligations of the Parties, under the Order, will be suspended for the duration of the force majeure and will resume as soon as the latter ceases.
The non-execution of an Order attributable to a case of force majeure shall not be subject to any recourse. In the event of such an event preventing the company HOPEN PROJECT from respecting its commitments. SUNDAY undertakes to inform the Customer as soon as possible.
